Will Instructions

Wills, Powers of Attorney & Estate Planning

How this works. Complete the form below on your phone or computer and tap Submit. This captures your instructions for your will — it is not the will itself. We will prepare the document from your answers and you will need to attend our office (or arrange a time with us) to sign it correctly, with witnesses. Fields marked * are required. Please do not type passwords, PINs or full account numbers into this form — a separate, secure estate information sheet can capture that. If you or a child are in immediate danger, call 000.

Your contact details

Part 1 - About you

Any other names you are, or have been, known by
Are you about to marry or enter a registered relationship?

Part 2 - Executors

Your executor administers your estate and carries out your will. Choose someone you trust who is willing to act.
If your first executor cannot or will not act
If a professional (solicitor, accountant) acts as executor, should they be able to charge their usual professional fees?

Part 3 - Funeral, remains and digital affairs

Do you prefer burial or cremation?
Any details about the service, cemetery, or disposal of ashes
Organ and tissue donation
Who should receive your photos and messages, and any instructions for your online accounts, email or social media

Part 4 - Gifts

List any specific items, sums of money or charitable gifts you want to leave to particular people or organisations. You do not need to list everything — the residue clause in Part 5 deals with the rest of your estate.
E.g. "my car to my son Tom" — one gift per line
E.g. "$10,000 to my niece Amy" — one gift per line
Charity name (and ABN if known) and the amount or percentage
Who should receive your personal belongings (furniture, jewellery, household items), or how they should be divided

Part 5 - Residue of your estate

The "residue" is everything left over after your gifts, debts and expenses are paid — usually the largest part of your estate.
Who should receive the residue of your estate?
Names, relationships and shares/percentages
At what age should a child or young beneficiary receive their inheritance outright?

Part 6 - Guardians of minor children

Complete this Part only if you have children under 18.
E.g. that siblings be raised together, or stay in contact with particular family members

Part 7 - Superannuation and business interests

Do you have a binding death benefit nomination with your super fund?
Briefly describe any interests and what should happen to them

Part 8 - Family and special circumstances

Marital status
Full names and dates of birth, including adopted, step or estranged children, and any dependants with a disability
This helps us advise you on the risk of a family provision claim. We will discuss this with you — do not put sensitive reasons in writing elsewhere.
These may not automatically pass under your will — list anything relevant

Part 9 - Anything else
